Please read these Terms of Service ("Terms") carefully before using the VoiceZap mobile application operated by AppHaze Limited ("we," "our," or "us").

Acceptance of Terms

By downloading, installing, or using VoiceZap, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the app.

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use VoiceZap for your personal, non-commercial use on devices you own or control, subject to these Terms and the App Store Terms of Service.

Description of Service

VoiceZap is a meeting recording and AI transcription application that helps you:

• Record audio from meetings, lectures, interviews, and conversations
• Generate AI-powered transcripts from your recordings
• Get automatic summaries with key points and action items
• Search and chat with your transcripts using AI
• Sync recordings across devices via iCloud
• Export transcripts to text or PDF

User Responsibilities

By using VoiceZap, you acknowledge and agree that:

• You are responsible for obtaining consent from all parties before recording any conversation
• You will comply with all applicable laws regarding audio recording in your jurisdiction
• You understand that recording laws vary - some jurisdictions require all-party consent
• You should maintain backups of important recordings
• You will use the app in compliance with all applicable laws

Recording Consent and Legal Compliance

CRITICAL WARNING - READ CAREFULLY:

VoiceZap provides tools to help you record audio. By using these features, you acknowledge and agree that:

• You are solely and exclusively responsible for obtaining proper consent before recording. We are not responsible for any legal consequences arising from your recordings.
• Recording laws vary significantly by jurisdiction. Some require consent from all parties being recorded (all-party consent), while others only require consent from one party (single-party consent).
• It is YOUR responsibility to understand and comply with the recording laws in your jurisdiction.
• Recording someone without proper consent may be illegal and could result in civil liability or criminal penalties.
• We strongly recommend informing all meeting participants that recording is taking place.
• We are not responsible for any legal issues, fines, penalties, or damages arising from your use of the recording features.

BY USING VOICEZAP'S RECORDING FEATURES, YOU EXPRESSLY ACKNOWLEDGE THAT YOU UNDERSTAND THESE LEGAL REQUIREMENTS AND ACCEPT FULL RESPONSIBILITY FOR COMPLIANCE.

AI Transcription and Processing

VoiceZap uses OpenAI's services for transcription and AI features. By using these features:

• You acknowledge that your audio will be sent to OpenAI for processing
• You agree to OpenAI's terms of service and privacy policy
• You understand that AI transcription may not be 100% accurate
• You are responsible for reviewing transcripts for accuracy, especially for important matters
• We are not responsible for any errors or inaccuracies in AI-generated transcripts, summaries, or action items

Data Storage Disclaimer

Important:

• Your recordings and transcripts are stored on your device or your iCloud account
• We do not store your recordings or transcripts on our servers
• You are responsible for backing up your data
• If you delete recordings or uninstall the app, your data may be permanently lost
• We are not responsible for any loss of recordings, transcripts, or data

In-App Purchases

VoiceZap may offer premium features through in-app purchases. By making a purchase:

• You agree to pay the displayed price
• Payment is processed through your Apple ID account
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions in your device's Settings > Apple ID > Subscriptions

Refunds are handled by Apple according to their refund policy. Please contact Apple Support for refund requests.

Intellectual Property

VoiceZap, including its design, features, code, graphics, and content, is owned by AppHaze Limited and is protected by intellectual property laws. You may not:

• Copy, modify, or distribute the app
• Reverse engineer or decompile the app
• Remove any copyright or proprietary notices
• Use the app for any commercial purpose without our permission

Disclaimer of Warranties

VOICEZAP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the app will be error-free, uninterrupted, secure, or free of viruses
• Warranties regarding the accuracy, reliability, or quality of transcription or AI features
• Warranties that recordings will be safe from loss or corruption
• Warranties that the app will be compatible with all devices or iOS versions

We do not warrant that VoiceZap will meet your requirements or that the operation of the app will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APPHAZE LIMITED, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:

• Any loss, deletion, or corruption of recordings, transcripts, or other data, whether caused by the app, user error, device malfunction, iOS updates, or any other reason
• Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from your use or inability to use the app
• Any damages resulting from errors, bugs, defects, or malfunctions in the app
• Any damages resulting from iOS updates, device changes, or third-party software that may affect app functionality
• Any damages resulting from inaccurate transcription or AI-generated content
• Any damages resulting from accidental deletion of recordings
• Any legal consequences arising from your recording activities
• Any damages resulting from failure to obtain proper consent before recording

Our total liability to you for all claims arising from or related to your use of VoiceZap shall not exceed the amount you paid for the app (if any) in the 12 months prior to the claim, or $10 USD, whichever is greater. If you obtained the app for free, our liability is limited to $10 USD.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless AppHaze Limited from any claims, damages, or expenses arising from your use of VoiceZap or violation of these Terms, including but not limited to claims arising from:

• Recording conversations without proper consent
• Violation of privacy laws or recording laws
• Any illegal use of the recording features

Modifications to the App and Service Availability

We reserve the right to modify, suspend, or discontinue VoiceZap at any time without notice. We are not liable for any modification, suspension, or discontinuation of the app.

The app's functionality may be affected by:

• iOS updates or changes to Apple's operating system
• Changes to OpenAI's services or APIs
• Device compatibility issues
• Third-party software conflicts
• Bugs, errors, or technical issues

We are not responsible for any loss of functionality, data, or recordings resulting from these factors.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms resulting from acts beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, natural disasters, power failures, internet outages, Apple App Store issues, OpenAI service disruptions, or changes to iOS or Apple's policies.

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms within the app or on our website. Your continued use of VoiceZap after changes constitutes acceptance of the updated Terms.

Termination

We may terminate or suspend your access to VoiceZap immediately, without prior notice, for any breach of these Terms. Upon termination, your license to use the app ends immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

No Guarantee of Recording Safety

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• VoiceZap is a tool that helps you record and transcribe audio, but it does not guarantee the safety or preservation of your recordings
• You use recording and transcription features at your own risk
• We strongly recommend maintaining separate backups of all important recordings
• We are not responsible for any consequences resulting from your use of recording features
• AI transcription may contain errors - you should review transcripts for accuracy
